SAN DIEGO, California (NV) — Cảnh tượng gia đình Gibram Cruz chào đón anh khi từ đơn vị về nhà ở San Diego hôm Thứ Năm, 19 Tháng Mười Hai tuần qua, cũng giống như mọi cảnh gia đình đoàn tụ khác trong mùa Lễ Giáng Sinh.

Trẻ nhỏ chơi trong sân nhà với người bác của chúng, một sĩ quan Lục Quân vừa từ đơn vị về nhà sáng hôm đó. Bà của chúng đang chăm sóc cho đứa bé nhỏ nhất chỉ mới lẫm chẫm bước đi. Khoảng sân nhỏ, có hàng rào bao quanh, rộn rã tiếng cười đùa của các đứa trẻ.

Nhưng trong niềm vui đoàn tụ này cũng tiềm ẩn nỗi lo lắng khi biết rằng ngay sau ngày lễ, người chủ gia đình, bà Rocio Rebollar Gomez, 50 tuổi, sẽ bị trục xuất khỏi nước Mỹ, theo bản tin của tờ báo San Diego Union-Tribune hôm Chủ Nhật, 22 Tháng Mười Hai.

Bà Rebollar Gomez đang chờ đợi có một phép lạ nào giúp cho mình, sau khi mọi nỗ lực pháp lý để bà được ở lại Mỹ đều thất bại. Bà vững tin rằng phép lạ sẽ đến, trước hạn định sở Cảnh Sát Di Trú (ICE) đưa ra cho bà để phải rời Mỹ là ngày 2 Tháng Giêng 2020 sắp tới.

“Món quà Giáng Sinh duy nhất mà chúng tôi mong muốn năm nay là để cho bà của các cháu được ở đây,” bà Rebollar Gomez nói.

Trong khi đó, người con trai của bà, Thiếu Úy Gibram Cruz, 30 tuổi, một sĩ quan tình báo, có được ba ngày phép với gia đình, sau khi từ đơn vị ở Arizona trở về.

Anh về đến phi trường San Diego vào sáng ngày Thứ Năm trước sự mừng đón hân hoan của gia đình. Anh phải trở lại đơn vị vào sáng ngày Chủ Nhật.

Anh sẽ không có thêm ngày phép nào để ở cùng với gia đình trong thời gian lễ, kể cả sinh nhật của bà mẹ hôm 29 Tháng Mười Hai.

“Tôi về nhà là để nói lời từ giã với mẹ tôi,” Thiếu Úy Cruz nói với tờ báo.

Là một sĩ quan tình báo, thủ tục xin phép để ra khỏi nước Mỹ vì lý do cá nhân rất phức tạp, theo Thiếu Úy Cruz, do vậy anh biết là sẽ rất khó khăn để có thể đi thăm mẹ sau khi bà bị trục xuất khỏi Mỹ.

Bà Rebollar Gomez từng nộp đơn xin được ở lại Mỹ theo một chương trình đặc biệt dành cho thân nhân của các quân nhân Mỹ, trong thời gian họ còn tại ngũ. Nhưng chương trình đó tùy thuộc vào sự chấp thuận của các giới chức ICE, và cơ quan này thông báo bác đơn của bà Gomez hồi đầu Tháng Mười Hai.

Luật sư Tessa Cabrera của bà Gomez đã gửi đơn xin ICE xét lại quyết định của mình, và một số giới chức Quốc Hội Mỹ cũng đã có nỗ lực giúp đỡ. Nhưng cho tới nay, ICE vẫn nhất quyết trục xuất bà Rebollar Gomez.

Tuy chưa hề phạm tội hình sự khi ở Mỹ, vấn đề di trú của bà Rebollar Gomez cũng rất phức tạp.

Bà đến Mỹ lần đầu vào năm 1988. Đến giữa thập niên 90, bà bị bắt trong một cuộc bố ráp của cơ quan di trú tại khách sạn nơi bà làm việc, khi có bầu được bảy tháng đứa con gái út, và bà bị đưa về Mexico cùng ngày.

Bà phải nhanh chóng tìm cách vượt biên giới quay trở lại Mỹ, vì còn có hai đứa con cần sự chăm sóc của bà.

Bà hai lần bị bắt và trục xuất trong những năm sau đó.

Hình ảnh bà mẹ bị nhân viên di trú đến nhà bắt dẫn đi vào một buổi sáng ngày Thứ Bảy vẫn là điều ám ảnh Thiếu Úy Cruz, lúc đó còn đang học trung học. Ông kể rằng sau khi bà mẹ bị bắt, anh em ông trở thành kẻ vô gia cư.

Nhưng sau mỗi lần bị trục xuất, bà Reboller Gomez lại tìm đường quay trở lại với các con và xây dựng lại mái nhà. Bà cũng dành dụm để mua được căn nhà mấy năm trước đây và đang sửa lại từ từ.

Sau khi học xong đại học, anh Cruz phải bỏ ước mơ vào trường luật để gia nhập quân đội Mỹ. Anh hy vọng rằng việc phục vụ trong quân đội sẽ giúp cho bà mẹ được ở lại.

Khi bà mẹ bị ICE bắt lần nữa vào năm 2018, cùng khoảng thời gian anh hết hạn khế ước đầu quân, anh quyết định ở lại quân đội, với hy vọng sẽ giúp phần nào cho nỗ lực vận động để mẹ được ở lại Mỹ.

Bà Rebollar Gomez không muốn nói gì với gia đình về những điều có thể xảy ra. Nhưng trong buổi tối Thứ Năm tuần qua, bà nói sẽ theo ý muốn của Thượng Đế dành cho bà, cho dù điều đó là gì chăng nữa.

Ngồi trong sân nhà, nhìn sự đầm ấm sum họp gia đình, bà Rebollar Gomez, nói bà không có gì để hối hận là đã cố gắng để có một đời sống ở Mỹ. “Đời sống của các con tôi là sự đền bù xứng đáng. Tất cả sự hy sinh của tôi đều đáng giá. Khi nhìn con cháu mình ở đây, học hành đầy đủ, và nhìn lại tôi thấy tất cả đều đáng giá.”

Nếu vào phục vụ cho quân đội để cho cha/mẹ (những người di cư bất hợp pháp)
được ở lại Mỹ, thì có rất nhiều Mexican Americans vào quân đội rồi, có thể nói overflow. Luật này đã có từ lâu lắm rồi... Phải chọn một trong hai điều kiện: một Là ẵm con về Mễ, hai là để con nhỏ lại Mỹ và về Mễ một mình...
