(Politico) – Tổng thống Donald Trump vào hôm thứ Tư cho hay, chính phủ của ông sẽ kêu gọi Tối cao Pháp viện băi bỏ ObamaCare, giữ nguyên quan điểm tấn công pháp lư toàn diện vào Đạo luật Chăm sóc Sức khỏe giữa bối cảnh đại dịch đang ảnh hưởng đến hàng triệu người Mỹ phụ thuộc vào chương tŕnh này.


Chính phủ dường như đang tăng cường chiến lược pháp lư đối với ObamaCare, ngay cả sau khi Tổng trưởng Tư pháp William Barr cảnh báo những hậu quả chính trị đối với việc làm suy yếu chương tŕnh y tế này trong thời gian khủng hoảng virus corona.

Dân chủ giành lại quyền kiểm soát Hạ viện và nghị viện tiểu bang trên khắp cả nước cách đây 2 năm bằng hứa hẹn sẽ bảo vệ ObamaCare, đặc biệt những điều khoản bảo vệ ngăn cấm người bệnh bị từ chối bảo hiểm hoặc bị tính bảo phí cao hơn v́ t́nh trạng sức khoẻ. Vấn đề này có thể chứng minh quan trọng hơn vào tháng 11 trong bối đại dịch COVID 19, t́nh h́nh mà các chuyên viên y tế tin rằng sẽ kéo dài qua mùa Thu.

Bộ Tư pháp có hạn chót vào thứ Tư để đệ lên Tối cao Pháp viện quan điểm của họ về hồ sơ kiện của các tiểu bang Cộng hoà. Tổng thống Donald Trump vào chiều thứ Tư tuyên bố trước truyền thông, chính phủ của ông giữ nguyên quan điểm. “ObamaCare là thảm hoạ, nhưng chúng tôi sẽ làm cho nói hầu như không chấp nhận được,” Tổng thống nói.

Bộ Tư pháp hiện chưa đưa ra lời b́nh luận.

Theo lịch, Tối cao Pháp viện vào mùa Thu sẽ phán xử vụ kiện. Các tiểu bang Cộng hoà lập luận, Đạo luật Chăm sóc Sức khỏe Giá cả phải chăng ACA hay c̣n gọi là ObamaCare vi hiến sau khi Quốc hội loại bỏ điều khoản phạt thuế nếu không có bảo hiểm y tế. Đây là phần quan trọng trong ObamaCare, và nếu nó không có hiệu lực th́ toàn bộ Đạo luật cũng sẽ không có hiệu lực. Một liên minh luật sư từ các tiểu bang Dân chủ và Hạ viện do Dân chủ kiểm soát sẽ bảo vệ Đạo luật trước ṭa.

Chính phủ Trump trước đây thay đổi quan điểm pháp lư về vấn đề này, nhưng có vẻ như họ đă quyết định không làm như vậy nữa. Bộ Tư pháp ban đầu lập luận rằng, các toà nên băi bỏ chỉ điều khoản bảo vệ t́nh trạng đă có sẵn bệnh tật trước khi mua bảo hiểm. Nhưng vào năm ngoái, họ lại yêu cầu băi bỏ hoàn toàn ObamaCare.

Tối cao Pháp viện dự tính sẽ nghe hai bên tranh căi bắt đầu vào tháng 10, nhưng chưa có lịch cụ thể. Sẽ khó có phán quyết cuối cùng trước tổng tuyển cử vào ngày 3 tháng 11. Toà Tối cao trước đây giữ nguyên ObamaCare trong hai vụ kiện lớn đe dọa sự sống c̣n của đạo luật.

Khoảng 20 triệu người dân được ObamaCare cung cấp bảo hiểm y tế, và Đạo luật sẽ cung cấp bảo hiểm xă hội lớn trong thời kỳ kinh tế rơi tự do do virus corona gây ra. Hàng triệu người sẽ tham gia vào Medicaid, đặc biệt những tiểu bang tham gia vào chương tŕnh mở rộng ObamaCare cho người trưởng thành có thu nhập thấp. Những người mất bảo hiểm y tế ở chỗ làm có thể ghi danh vào ACA, mặc dù chính phủ ông Trump quảng cáo ǵ nhiều về các chọn lựa.

Các viên chức hàng đầu của ông Trump bị chia rẽ về vấn đề chiến lược pháp lư trong vụ kiện ObamaCare. Tổng trưởng Barr và Bộ trưởng Y tế & Nhân sinh Alex Azar đều phản đối tấn công đạo luật toàn diện, nhưng Toà Bạch Ốc lại ủng hộ, v́ họ xem đây là cơ hội hoàn thành lời hứa hẹn vận động tranh cử của ông Trump.

William Barr vào thứ Hai đă có cuộc họp với Phó Tổng thống Mike Pence, Luật sư Toà Bạch Ốc Pat Cipollone, và Tùy viên báo chí Toà Bạch Ốc Kayleigh McEnany, cùng các cố vấn ở Hội đồng Chính sách Nội địa, thuyết phục chính phủ nên dịu giọng về quan điểm pháp lư trong vụ ObamaCare.

William Barr từ lâu lo ngại về những hậu quả chính trị của việc băi bỏ toàn bộ ObamaCare, thậm chí bây giờ ông quan ngại nhiều hơn, nhất là trong khủng hoảng virus corona. Ông Barr muốn Toà Bạch Ốc vẫn giữ một số phần trong đạo luật, nhưng lại vấp phải sự phản đối mạnh mẽ từ phe phái ở Toà Bạch Ốc hiện đang muốn ông Trump giữ lời hứa băi bỏ ObamaCare.

Theo cá nhân Tôi nghĩ Obamacare th́ quá tốt cho dân nghèo nhưng lại không hoàn chỉnh và không công bằng cho dân Middle class v́ họ không đủ điều kiện gia nhập chương tŕnh này thế nên họ phải trả premium Insurance quá cao .. nếu chính phủ Trump sửa đổi và điều chỉnh lại th́ quá hay ..không cần xoá bỏ ..
.. c̣n lại dân Upper middle class income trên 150k 1 năm th́ họ thừa sức trả ..

Uh, cái này th́ tôi đồng ư. Nên để option cho dân chọn thay v́ ép buộc bắt phải mua bảo hiểm.

Tâm lư con người thường ưu tiên nghĩ về lợi ích hiện tại, nhu cầu cho tương lai chỉ là thứ yếu. Tự nhiên đang khoẻ mạnh mà bảo mua bảo hiểm sức khoẻ hay nhân thọ là điều vô lư và xa xỉ !! Đến khi sự việc tồi tệ xảy ra th́ họ mới thấy sự cần thiết về điều này. Nếu để tự nguyện đi mua sự an toàn th́ hầu hết ai cũng nói không vội, đợi từ từ sẽ tính sau. Sau đó sẽ quên hẳn và cuối cùng vào bệnh viện mà tiền th́ lỡ xài hết.
Đó là lư do v́ sao luật mua Obama care là bắt buộc mà không để tự nguyện. Giống như trường hợp Canada cho mỗi người dân được quyền bỏ tiền vào quỹ hưu trí 18% lợi tức hằng năm và được quyền khai thuế 100%. Điều này đă khuyến khích rất nhiều người dân hưởng ứng. Kết quả rất ít người xin tiền xă hội hay homeless v́ đa số điều có tiền tiết kiệm.
