Chủ tịch Quốc hội Nguyễn Sinh Hùng nhấn mạnh, quyết chủ trương đầu tư là cơ quan dân cử, quyết dự án là thủ trưởng cơ quan hành pháp.

Từng được bàn thảo nhiều chiều tại Ủy ban Thường vụ Quốc hội từ phiên họp tháng 2/2014, quy định xử lư trách nhiệm liên quan đến quyết định chủ trương đầu tư công tại dự án Luật Đầu tư công lại tiếp tục gây tranh căi tại hội nghị đại biểu Quốc hội chuyên trách, sáng 11/4.

Theo dự thảo luật mới nhất, người có thẩm quyền quyết định chủ trương đầu tư các chương tŕnh, dự án sai, kém hiệu quả, không cân đối được vốn để thực hiện gây thất thoát, lăng phí do lỗi ḿnh gây ra phải chịu trách nhiệm bồi thường thiệt hại và bị xử lư kỷ luật theo quy định của pháp luật.

Dự thảo luật cũng quy định, tổ chức, cá nhân liên quan đến lập, thẩm định dẫn đến quyết định chủ trương đầu tư sai, kém hiệu quả do lỗi ḿnh gây ra phải chịu trách nhiệm bồi thường thiệt hại và bị xử lư vi phạm theo quy định của pháp luật.

Đặt câu hỏi, Quốc hội phê chuẩn dự án sai liệu có kỷ luật được Chủ tịch Quốc hội không, đại biểu Nguyễn Bá Thuyền cho rằng nếu quyết định chủ trương đầu tư là tập thể, th́ không thể kỷ luật được.

Nhận xét lĩnh vực đầu tư công vốn nhiều tai tiếng, thất thoát, tham nhũng làm xói ṃn niềm tin của nhân dân, đại biểu Ngô Văn Minh cho rằng quyết định chủ trương đầu tư sai là gốc của lăng phí tham nhũng. V́ thế, đề xuất đầu tư sai th́ phải xử lư.

Ông Minh phân tích, đă quyết định chủ trương đầu tư các chương tŕnh, dự án sai, kém hiệu quả, là có dấu hiệu phạm tội. Nên nếu chỉ nói phải bồi thường thiệt hại và kỷ luật là không đúng mà phải xử lư theo quy định của pháp luật, kể cả truy cứu trách nhiệm h́nh sự.

Đại biểu Minh cũng đặt vấn đề, quy định tổ chức, cá nhân liên quan đến lập, thẩm định dẫn đến quyết định chủ trương đầu tư sai, kém hiệu quả do lỗi ḿnh gây ra phải chịu trách nhiệm bồi thường thiệt hại và bị xử lư vi phạm là cách chơi chữ, hay có vùng cấm ǵ chỗ này? Quy định như vậy theo ông Minh c̣n rất mập mờ, cần chỉnh sửa cho chặt chẽ hơn nữa.

Trở lại quan điểm đă phát biểu ở Ủy ban Thường vụ Quốc hội về quyết chủ trương đầu tư và quyết dự án là hai chuyện khác nhau, Chủ tịch Quốc hội Nguyễn Sinh Hùng nhấn mạnh, quyết chủ trương đầu tư là cơ quan dân cử, quyết dự án là thủ trưởng cơ quan hành pháp.

Tuy nhiên, không phải tất cả công tŕnh đều đưa ra Quốc hội và hội đồng nhân dân quyết, mà Quốc hội chỉ quyết chủ trương các công tŕnh đặc biệt quan trọng tác động đến toàn bộ nền kinh tế, v́ thế tiêu chí của dự án đưa ra Quốc hội quyết chủ trương đầu tư là phải rơ trong luật, Chủ tịch lưu ư.

Theo Chủ tịch, Quốc hội là cơ quan lập pháp, nếu quyết sai cũng phải nhận khuyết điểm chứ không phải kỷ luật, Chủ tịch Quốc hội cũng không phải người đứng đầu Quốc hội. V́ thế, không thể v́ cả 500 đại biểu bỏ phiếu mà kỷ luật cả 500 vị hay kỷ luật ông Chủ tịch.

“Quốc hội tức là dân, dân quyết sai th́ dân chịu, chứ kỷ luật ai”, Chủ tịch Nguyễn Sinh Hùng nhấn mạnh.

Ông cũng cho rằng Quốc hội không nên quyết các vấn đề quá cụ thể của các dự án đầu tư công, mà phải để Thủ tướng, bộ trưởng, chủ tịch ủy ban quyết.

Với nhận xét quy định về trách nhiệm tại dự thảo luật vẫn như ḍng sông êm đềm không vướng víu, đại biểu Đỗ Văn Đương đề nghị cần phải phân định rơ trách nhiệm của người quyết định chủ trương đầu tư và quyết dự án cụ thể.

Bởi có dự án được tŕnh Quốc hội quyết chủ trương nhưng trên thực tế đại biểu không nắm được đầy đủ thông tin để đưa ra quyết định chính xác. Đồng thời hàng năm, địa phương phải báo cáo công tŕnh nào đầu tư sai không hiệu quả để khắc phục, đi liền với xử lư trách nhiệm của tập thể, cá nhân có liên quan.

Nếu chỉ nói xử lư theo quy định của pháp luật th́ nghe êm đềm lắm, đại biểu Bùi Văn Phương đồng t́nh với đại biểu Đương.

Cho rằng c̣n một số vấn đề lớn sẽ mắc khi sửa Luật Ngân sách, đại biểu Đinh Văn Nhă đặt vấn đề nên lùi việc thông qua Luật Đầu tư công đến kỳ họp Quốc hội thứ 8 thay v́ thông qua tại kỳ họp thứ 7 tới.
