Không phải cứ CSGT tuưt c̣i th́ chắc chắn ḿnh bị phạt.

Người Việt có thói quen khi công an hỏi giấy tờ th́ cứ đưa mà mặc nhiên không biết rằng ḿnh có quyền giải thích, chứng minh ḿnh không vi phạm luật giao thông. Và khi đă chứng minh được th́ không có nghĩa vụ phải xuất tŕnh giấy tờ xe.
Tùng - nhân viên văn pḥng ở TP.Hồ Chí Minh chia sẻ kinh nghiệm ứng xử khá thông minh của ḿnh: "Cách xưng hô rất quan trọng -có thể giúp bạn giải thích thành công về những lỗi vi phạm. Khi gặp CSGT tôi không gọi anh em mà xưng tui và đồng chí.

Khi được CSGT thông báo là chạy lấn tuyến và yêu cầu cho xem bằng lái, bảo hiểm, giấy đăng kư xe; tôi đă nhanh chóng giải thích: Tôi không chạy lấn tuyến, không vi phạm nên không tŕnh giấy tờ xe. Thế là được cho đi".

Một cách khá chuyên nghiệp, một thành viên mạng xă hội 5giay chia sẻ: "Anh em có thể trang bị 1 cây bút bi camera vắt vào túi đề pḥng những trường hợp xấu sẽ quay phim lại. Xong rồi nói nhẹ với CSGT: Tôi đă ghi lại tất cả hành vi của đồng chí..."

Người dân có quyền chứng minh ḿnh không vi phạm

Cách đây không lâu cộng đồng mạng xôn xao clip một người lái xe ô tô giải thích khá quyết liệt rằng ḿnh không vi phạm luật.

Khi bị vặn lại, Cảnh sát giao thông đă phải xin lỗi và cho người dân này đi. Điều này cho thấy người dân đă dần hiểu biết pháp luật hơn và bảo vệ được quyền lợi chính đáng của ḿnh.

Điều 14 Thông tư số 65/2012/TT-BCA ngày 30/10/2012 của Bộ Công an quy định cảnh sát giao thông chỉ được dừng phương tiện để kiểm soát khi trực tiếp phát hiện hoặc thông qua phương tiện, thiết bị kỹ thuật nghiệp vụ phát hiện, ghi nhận được các hành vi vi phạm pháp luật về giao thông đường bộ.

Nói cách khác, chỉ phải xuất tŕnh giấy tờ nếu CSGT đă chứng minh rơ ràng là người đi đường phạm lỗi ǵ đó cụ thể.

Ngoài ra c̣n một số trường hợp khác được dừng nhưng ít gặp hơn, chẳng hạn khi nhận được tin báo của cơ quan, tổ chức, cá nhân về hành vi vi phạm pháp luật của người và phương tiện tham gia giao thông.

CSGT chỉ được kiểm tra giấy tờ nếu phát hiện có lỗi.

Khi CSGT chặn xe bạn v́ lỗi vượt quá tốc độ tối đa, trong khi bạn chắc chắn rằng ḿnh không hề vượt quá, bạn có quyền yêu cầu được xem h́nh ảnh, kết quả ghi thu được và cảnh sát có nghĩa vụ phải cho xem.

Nếu CSGT không đưa ra được bằng chứng chứng minh bạn vượt quá tốc độ cho phép th́ không được phép lập biên bản và cũng không được phép kiểm tra giấy tờ bạn.

Quá đơn giản. Chỉ cần móc bóp rồi ch́a tiền ra là xong ngay. C̣n như rầy rà th́ xe bị mang về đồn công an. Người ta vào c̣n không có mạng để ra. Xe vào đó rồi th́ c̣n cái bàn đạp ra cửa.
